Spain Golden Visa Citizenship

Spain Golden Visa Citizenship can be acquired by entrepreneurs and investors as an alternative to usual acquisition through buying property.
Article Published: 04 Jun, 2020, Updated: 19 Jan, 2023 under Golden Visa (Non-EU)

Most people are aware of – and choose – the route of buying property in order to obtain Citizenship of Spain.
However there are other alternatives that are more appropriate to some individuals seeking a Golden Visa in Spain.

Options for Spain Golden Visa Citizenship

Alternatives to acquire Spanish residency include the Residence Visa for Entrepreneurs and Business Activity (REM) and the Residence Visa for Capital Investors (RIC).

Although they do not properly establish a possibility of acquiring residence directly by buying a property, they do offer investment alternatives to reside in Spain.

Spain Golden Visa Citizenship for Entrepreneurs and Business Activity

The Visa for Entrepreneurs and Business Activity (REM) includes investors who present a business project that is going to be developed in Spain and that is considered and accredited as of general interest and those who plan to enter and stay in Spain for a period of one year in order to carry out the prior procedures necessary for this purpose. An entrepreneurial activity will be understood as one that is innovative in nature with special interest to Spain.

Spain Golden Visa Citizenship for Capital Investors

For the second option, the Residence Visa for Capital Investors (RIC), significant capital investment is understood as an initial investment with a value equal to or greater than 2 million euros in Spanish national debt or with a value equal to or greater than 1 million euros in shares or social participations of Spanish companies or deposits banks in Spanish financial institutions.

The residence visas issued under these options constitutes sufficient title to reside in Spain for a year without the need to process the foreigner's identity card. The possibility of processing the residence visa extends to the spouse and children under 18 years of age who would have to request also residency under this alternative.

After the visa has been approved for a period of one year there would then be the possibility to submit a residency request for two years and subsequent renewals if the business/investment conditions are kept. As a general rule a 10 years residency in Spain will allow a resident to apply for Spanish citizenship if all standard legal requirements are complied with.

Who Is This Service For?

Introduced by Law 14/2013, the Golden Visa programme in Spain offers high net-worth individuals and their families the possibility to live and work in Spain.

The Visa is initially valid for two years, renewable for 5 years and eventually a permanent residency visa and even naturalisation to become a Spanish citizen (after 10 years residency) is an option.

Requirements

  • Main applicant must be over 18 years of age
  • Valid passport
  • Valid Birth Certificate
  • Suitable private health insurance
  • No criminal record in Spain or in country of Origin
  • Evidence of having made one of the approved investments

Approved Investments

The most popular qualification route is the purchase of property valued at €500,000 (without a mortgage).

The visa permits the holder to enter and exit Spain as and when they wish, without any requirement to spend a minimum period of time in Spain, as is typically the case with other residency visas issued in Spain. Other options include:

  • A significant business investment that either involves meaningful job creation or is likely to have a significant socioeconomic impact in the area where the investment takes place or is an innovitave business with technological or scientific impact
  • €2 million on Spanish Treasury bonds
  • €1 million on Spanish company shares
  • €1 million in investment funds
  • €1 million in bank deposits in Spanish financial institutions

Benefits

  • Expedited Process (much simpler than other visa application processes)
  • Goldent Visa holder may leave and return to Spain as often as they wish without restriction
  • This visa confers a right to both live and work in Spain
  • Longer residency approved initially with less renewal requirements
  • Ability to bring your family

Potential Issues

Unfortunately, it is common to see applications fail because the applicant failed to provide the detailed information that the local authorities demand to receive before granting approval.

This can of course be avoided by contracting an experienced immigration lawyer to manage the process on your behalf.
