Restraining Orders

This service is available across France

Who Is This Service For?

This service is for English-speaking individuals in France who are victims of domestic violence, harassment, or threats and need urgent legal protection through a restraining order (ordonnance de protection).

It is especially relevant for:

  • Individuals facing violence or threats from a spouse, ex-partner, or family member

  • Those needing immediate legal protection while pursuing separation or custody proceedings

  • Victims of stalking or psychological abuse seeking urgent court intervention

Our bilingual legal team ensures you have immediate access to the French legal system and helps you obtain the protection you need swiftly and effectively.

Who Is This Service For?

Useful Information

In France, restraining orders are called ordonnances de protection, introduced by Law No. 2010-769 and detailed in Articles 515-9 to 515-13 of the French Civil Code.

  • Who can apply: Any person suffering or at risk of violence from their current or former partner (married, PACSed, or cohabiting), or from another family member.

  • What it does: A protection order may:

    • Prohibit the aggressor from contacting or approaching the victim

    • Expel them from a shared residence

    • Suspend parental authority

    • Provide temporary housing and financial support

    • Authorise the victim to conceal their address

  • How it works:

    • The request is made to the Family Judge (JAF) at the Tribunal Judiciaire

    • A decision is typically made within 6 days

    • No criminal complaint is required to file — civil protection is available independently

  • Duration: A restraining order is valid for up to 6 months, renewable if necessary, or until related criminal or family court proceedings conclude.

Useful Information

Process: Our Approach

  • Urgent Consultation: We review your situation and determine whether an ordonnance de protection is appropriate.

  • Petition Preparation: We draft the request and gather supporting evidence (e.g. medical certificates, witness statements, messages).

  • Court Filing: We file your request with the Family Court and ensure it's treated as an urgent matter.

  • Representation at Hearing: We represent you before the judge and argue for the necessary protective measures.

  • Order Enforcement: We ensure the restraining order is enforced by the police and registered with relevant agencies (e.g. local prefecture or social services).

  • Post-Issuance Support: We assist with related matters such as filing for divorce, child custody, or long-term residence adjustments.
